Driving with Suspended License (N.J.S.A. 39:3-40)

“No person to whom a driver's license has been refused or whose driver's license or reciprocity privilege has been suspended or revoked, or who has been prohibited from obtaining a driver's license, shall personally operate a motor vehicle during the period of refusal, suspension, revocation, or prohibition…”

Driving with a suspended license has potentially very serious consequences if you plead guilty or are found guilty. For a first offense, there is a fine of $500 and potentially a further suspension of your driving privileges. For a second offense, the fine is $750, further suspension of your driving privileges, and mandatory imprisonment for a period of at least one (1) day, but no more than five (5) days. For any subsequent offense, the fine is $1,000, imprisonment is mandatory for ten (10) days, and further suspension of your driving privileges. If you are driving while suspended and are involved in an accident resulting in bodily injury, the period of imprisonment is at least 45 days. Furthermore, the penalties are even greater if your license was originally suspended due to a DUI or DWI conviction. Lastly, your insurance company can issue their own “insurance points” for their records and potentially raise your insurance rates or charge you a surcharge.
